A few days ago, a new Australian court ordered Pfizer to pay $100m to settle a lawsuit over the purchase of a generic version of Viagra. The price of Viagra was $7.45 per tablet, but Pfizer has since paid the same price, as well as the price of the generic. Pfizer’s legal action against the Australian Government over the purchase of the generic is in response to the Court’s ruling by the Australian Competition and Consumer Commission (ACCC) in November. This decision was a major blow to Pfizer’s brand, but it is not the first time it has been affected by the price of generic drugs.

A spokesperson for Pfizer said that the ACCC decision “provides us with a clear warning that price competition is an issue that cannot be dismissed on the basis of the available evidence.”

Pfizer has not responded to requests for comment.

The court had ordered that a generic version of Viagra be sold in Australia at a price that could be cheaper than the branded version.

“We are pleased that Australian Competition and Consumer Commission has been able to take legal action to protect consumers from a potentially costly generic version of Viagra,” said the ACCC spokeswoman. “However, the ACCC will not comment on the case and the ACCC will not pursue any action that may be necessary to defend the ACCC’s decision.”

Pfizer said that the decision was made “in consultation with the Australian Government and/or the Australian Competition and Consumer Commission (ACCC).” The court has not decided the case, and Pfizer is not certain what action the Australian Competition and Consumer Commission should take. The ACCC is still waiting to hear oral arguments from the Government.

Pfizer’s decision to settle the case with the Australian Competition and Consumer Commission was based on ‘information from the relevant government and/or the Australian Government’s views’. In the decision, the ACCC says the government is seeking to establish a standard of conduct for the Australian Competition and Consumer Commission for assessing whether a generic drug is likely to be more effective than Viagra.

Pfizer had previously been ordered by the ACCC to refund the price of Viagra as a condition of its refund.

In December 2017, Pfizer received an order from the Australian Competition and Consumer Commission (ACCC) to refund the price of Viagra as a condition of its refund. Pfizer’s decision to pay the Australian Competition and Consumer Commission was based on information from the Australian Government and/or the Australian Government’s views.
